Supreme Court Upholds Bail for Honeymoon Murder Accused Despite Procedural Lapses

The Supreme Court has decided against cancelling the bail granted to Sonam Raghuvanshi, the woman accused of murdering her husband during their honeymoon. The apex court's decision comes despite acknowledging serious procedural irregularities in how the case was initially handled by law enforcement authorities.

Raghuvanshi's bail was originally sanctioned by the Meghalaya High Court, which identified a critical administrative error in the police's investigation and chargesheet filing. The investigating officers had incorrectly referenced a non-existent legal provision while building the case against her, and crucially failed to formally apprise her of the specific murder charges being lodged. These oversights created significant gaps in the legal proceedings that influenced the High Court's decision to grant bail.

The Supreme Court bench, while expressing reservations about the circumstances surrounding the bail grant, ultimately recognised that Raghuvanshi had been released from custody and had been complying with the conditions imposed on her freedom. The court acknowledged the unusual nature of the procedural failures but determined that revoking bail at this stage would not serve justice given these foundational errors in the case proceedings.

This decision highlights how procedural safeguards in criminal investigations remain critical even in serious charges like murder. The case demonstrates the importance of rigorous adherence to legal protocols during the investigation phase, as lapses can have far-reaching consequences on case outcomes.

The bail order remains in effect, allowing Raghuvanshi to maintain her freedom pending trial. The case will continue through the judicial system as the substantive merits of the murder charge are examined by the courts.
