Tenants in India now have clear legal protection against surprise visits from landlords, thanks to provisions in the Model Tenancy Act of 2021. Under this legislation, property owners must provide at least 24 hours of written notice before entering any rented residential space, ensuring renters' right to privacy is safeguarded.

The law specifies strict requirements for landlord entry. Any notice must be provided in writing and must clearly state the specific reason for the visit along with the exact time of entry. This requirement applies to all routine situations where landlords need access to their properties, such as conducting maintenance work, performing repairs, or carrying out inspections. The timing of entry is also restricted — landlords can only access rented properties between sunrise and sunset, preventing unreasonable visits during night hours when tenants might feel vulnerable or inconvenienced.

However, the legislation recognizes that certain unforeseen circumstances warrant immediate action. In genuine emergencies such as fires, flooding, or other life-threatening situations, landlords are permitted to enter without prior notice. These exceptions exist because waiting 24 hours could endanger lives or result in significant property damage. The act aims to balance landlords' legitimate need to maintain and inspect their properties with tenants' fundamental right to privacy and peaceful enjoyment of their rented homes.

This regulation represents a significant shift toward tenant protection in India's rental market. Previously, many tenants faced arbitrary visits and had little recourse against intrusive landlords. The Model Tenancy Act provides a clear, enforceable framework that both parties must follow. For renters across India, this means they now have legal grounds to refuse entry if proper notice hasn't been provided.

Tenants should keep records of all written notices they receive from landlords and document any instances where entry rules are violated. Similarly, landlords must adhere to these procedures to avoid legal disputes. As states gradually adopt or align their tenancy laws with the Model Tenancy Act framework, these protections are becoming increasingly standardized across India's rental housing sector.
