MP High Court Fines Man Rs 5,000 For Misusing Habeas Corpus
Man's plea to recover son dismissed, court calls it misuse of process

The Indore bench of the Madhya Pradesh High Court has dismissed a habeas corpus plea filed by a man, Rajesh Sharma, seeking the recovery of his son who had allegedly gone missing.
The court termed the petition a 'sheer misuse of the process of the court' and imposed a fine of Rs 5,000 on the petitioner.
According to the police records, Sharma's son had eloped with a girl and flown to Ahmedabad, and was not unlawfully detained as claimed by the petitioner.
Sharma had approached the High Court claiming that his son had gone missing on March 10, 2025, but had lodged a missing person report only on May 6, 2025, nearly two months after the alleged disappearance.
During the proceedings, Government Advocate Harish Singh Rathore presented findings from the case diary, which revealed that the girl had also gone missing around the same period, on April 29, 2025.
The police investigation subsequently revealed that Sharma's son had taken the girl on a flight from Gwalior to Ahmedabad, and an FIR was registered at Morar Police Station in Gwalior against the son, along with his uncle and aunt.
The State argued that Sharma filed the writ petition to build a legal defence for his accused son while suppressing facts about the alleged elopement.
The petitioner's counsel, Abhishek Mantri, submitted that Sharma was merely a father unaware of his son's actions or whereabouts.
However, the court was unconvinced by the defence and observed that the extraordinary constitutional remedy was being misused.
Justice Subodh Abhyankar noted that given the nearly two-month delay in filing the police complaint and omission of material facts, the petition lacked merit.
The court directed Sharma to deposit Rs 5,000 in the account of the High Court Employees Union within two weeks.
This judgment highlights the importance of ensuring that constitutional remedies are not misused for personal gain or to circumvent the law.
The court's decision also underscores the need for petitioners to be truthful and transparent in their claims, and to provide all relevant information to the court.
In this case, the petitioner's failure to disclose material facts and the delay in filing the police complaint led to the dismissal of the plea and the imposition of a fine.
The judgment serves as a reminder that the courts will not tolerate misuse of the legal process and will take strict action against those who attempt to do so.
The case also raises questions about the responsibility of parents to ensure that their children do not engage in illegal activities, and the need for parents to be aware of their children's actions and whereabouts.
Ultimately, the court's decision is a significant one, as it upholds the integrity of the legal process and ensures that justice is served.
