High Court Orders Decision On Sattvaa Sector-B Layout Objections

The Indore Bench of the Madhya Pradesh High Court has ordered the Town and Country Planning (TNCP) Department to expeditiously decide objections to the layout sanction granted for the proposed Sattvaa Sector-B residential colony in Indore.

The residential colony, spread across 30 acres at Gram Badhiyakima in Bhicholi Hapsi tehsil, has been at the center of a title dispute. Advocate Manav Beniwal, representing the petitioners, stated that the developer, M/s Superlative Devcon LLP, obtained necessary approvals by suppressing the pendency of a civil suit concerning ownership of the land and by submitting false affidavits.

The petitioners, who are landowners, challenged the validity of the TNCP approval and claimed they had repeatedly filed objections since April 2023. However, the authorities had failed to decide on these objections. The Colony Cell of the Indore Collectorate revoked the colony development permission on June 30, 2026, citing suppression of material facts relating to the pending civil litigation.

Following the revocation order, the petitioners urged the TNCP Department and RERA to revoke their respective approvals as well. The High Court, taking note of the Colony Cell's revocation order, directed the TNCP Department to expeditiously decide the petitioners' objections seeking cancellation of the TNCP sanction.

The TNCP Department's decision on the objections is expected to bring clarity on the fate of the Sattvaa Sector-B residential colony. The case highlights the importance of transparency and due diligence in the approval process for residential colonies.

The petitioners' allegations of suppression of title dispute and submission of false affidavits by the developer have raised concerns about the integrity of the approval process. The High Court's order is a step towards ensuring that the authorities take a thorough look at the objections and make an informed decision.

The outcome of this case will have significant implications for the real estate sector in Indore. It will set a precedent for how authorities handle objections and disputes related to residential colonies. The decision will also impact the developers, who will need to ensure that they comply with all regulations and disclose all relevant information to avoid similar disputes in the future.

In conclusion, the High Court's order is a significant development in the case of Sattvaa Sector-B residential colony. The TNCP Department's decision on the objections will be closely watched, and its outcome will have far-reaching implications for the real estate sector in Indore.

The case also underscores the need for effective governance and oversight in the real estate sector. The authorities must ensure that developers comply with all regulations and that the approval process is transparent and fair. This will help to maintain public trust and confidence in the real estate sector.

The High Court's order is a positive step towards ensuring that the authorities take a thorough look at the objections and make an informed decision. It will help to bring clarity and transparency to the approval process for residential colonies in Indore.

The decision will have a significant impact on the petitioners, who have been seeking justice for their grievances. It will also impact the developer, who will need to comply with the authorities' decision and ensure that they disclose all relevant information to avoid similar disputes in the future.

In the end, the High Court's order is a significant development in the case of Sattvaa Sector-B residential colony. It will help to bring clarity and transparency to the approval process for residential colonies in Indore and will have far-reaching implications for the real estate sector.
