Indore Court Rejects NIA Probe In Badnagar Blast

The Indore bench of the Madhya Pradesh High Court has refused to order a National Investigation Agency (NIA) probe into the June 23 blast during a Muharram procession in Badnagar, Ujjain district.

The decision was made by a division bench of Justice Subodh Abhyankar and Justice Alok Awasthi, who were hearing a public interest litigation (PIL) filed by Sumit Hardiya. The petitioner had sought the transfer of the investigation to the NIA, arguing that the incident involved a scheduled offence under the National Investigation Agency Act, 2008.

During the hearing, the State Government informed the court that the explosives allegedly carried in the Tata Magic vehicle were actually firecrackers. Although the final report in the matter is still awaited, the court took note of the State Government's submission.

The bench observed that it was not inclined to accept the petitioner's contention that the incident required an NIA investigation. The court noted that the explosives were reportedly firecrackers and that the incident was a stunt carried out by a person whose men were already sitting in the van.

However, the court did not dispose of the petition. Instead, it granted the State Government four weeks to file a detailed reply regarding the remaining reliefs sought in the PIL. The matter will be listed thereafter.

The blast occurred on June 23 during a Muharram procession in Badnagar, Ujjain district. The incident had raised concerns about the safety and security of such processions. The petitioner had argued that the NIA should investigate the matter due to its potential implications.

The National Investigation Agency Act, 2008, empowers the NIA to investigate scheduled offences, which include terrorist acts and other serious crimes. However, in this case, the court has declined to order an NIA probe, citing a lack of evidence to warrant such an investigation.

The State Government's claim that the explosives were firecrackers has raised questions about the nature of the incident. While the final report is still awaited, the court's decision suggests that the incident may not be as serious as initially thought.
