Bombay HC Orders Re-inspection Of Park Inn Navi Mumbai

The Bombay High Court has directed the Food and Drug Administration (FDA) to conduct a fresh inspection of the Park Inn by Radisson hotel in Navi Mumbai. This comes after the hotel's FSSAI licence was suspended on July 3 following a surprise inspection.

The court's decision was made in response to a petition filed by the hotel, which challenged the suspension order passed by the Food Safety Officer. The petition claimed that the order was passed without providing the hotel with sufficient time to address the deficiencies found during the inspection.

The Division Bench of Acting Chief Justice Ravindra Ghuge and Justice Gautam Ankhad heard the petition and directed the Commissioner of the FDA to form a committee to inspect the hotel. The committee has been asked to inspect the premises on Saturday morning and submit its report by July 20.

The court's order states that if the report indicates that the hotel has addressed all the deficiencies, the suspension order will be withdrawn and the hotel will be permitted to operate. The hotel had scored 65 out of 108 (61 per cent) for non-compliance during the initial inspection.

The petition contended that the suspension order was passed without establishing any specific reason to circumvent the procedure of improvement notice and the time period provided to cure the defects. It also argued that the order was based solely on a numerical compliance score without any independent, qualitative finding that the specific deficiencies found were such as to render food at the premises unsafe.

The FDA had suspended the hotel's FSSAI licence with immediate effect, directing the hotel to cease and desist from carrying on any food business activity. However, with the court's order, the hotel has been given a chance to rectify the deficiencies and resume operations.

The case highlights the importance of following proper procedures in cases of non-compliance. The court's decision ensures that the hotel is given a fair chance to address the issues and maintain the highest standards of food safety.

The Park Inn by Radisson Navi Mumbai is a five-star hotel that caters to a large number of guests and customers. The suspension of its FSSAI licence had raised concerns about the safety of food served at the hotel.

The FDA is responsible for ensuring that food establishments in the state maintain high standards of hygiene and safety. The agency conducts regular inspections to monitor compliance with food safety regulations.

In recent times, the FDA has been cracking down on food establishments that fail to maintain proper hygiene and safety standards. Several eateries in Mumbai have had their licences suspended or cancelled due to non-compliance with food safety regulations.

The court's order in the Park Inn by Radisson Navi Mumbai case is a significant development in the ongoing efforts to ensure food safety in the state. It highlights the importance of following proper procedures and maintaining high standards of hygiene and safety in food establishments.

The outcome of the case will be closely watched by the hospitality industry and food safety regulators in the state. It is expected to have implications for the way food establishments are inspected and regulated in the future.

In conclusion, the Bombay High Court's order directing a fresh inspection of the Park Inn by Radisson Navi Mumbai is a significant development in the case. It ensures that the hotel is given a fair chance to address the deficiencies and maintain the highest standards of food safety. The case highlights the importance of following proper procedures and maintaining high standards of hygiene and safety in food establishments.
