A Mumbai court has awarded ₹5.01 crore to the family of Niraj Mehta, a 46-year-old Ghatkopar businessman who died in a road accident in Mahabaleshwar in 2024.

The Motor Accident Claims Tribunal (MACT) made this decision on August 4, rejecting the insurer's claims that the bus driver lacked a valid driving licence and that the vehicle had no valid permit.

The accident occurred on January 26, 2024, when Mehta was guiding another vehicle into a parking area near Mapro Garden in Mahabaleshwar. A bus allegedly emerged from the gate at high speed and knocked him down, resulting in his death.

The Panchgani police booked the driver, and the insurer alleged contributory negligence on Mehta's part. However, the tribunal held the bus driver responsible for the accident.

The compensation was awarded to Mehta's widow, two minor children, and elderly parents. The tribunal accepted Mehta's net annual income of ₹40.86 lakh and added 25% towards future prospects.

After deducting one-fourth for personal expenses and applying a multiplier of 13, the tribunal calculated the loss of dependency at ₹4.98 crore. Additional sums were awarded for conveyance, funeral expenses, loss of estate, and consortium.

This is the second time in recent weeks that the MACT has awarded compensation exceeding ₹5 crore. In July, the tribunal had awarded ₹19.97 crore to a 54-year-old Mulund resident who suffered 82% permanent disability in a 2022 accident.

The MACT's decision highlights the importance of ensuring that vehicles are properly licensed and insured, and that drivers are held accountable for their actions.

The compensation awarded to Mehta's family will provide them with some financial support during this difficult time.
