Mumbai Developer Ordered To Refund ₹53.41 Lakh To Homebuyer

The Maharashtra State Consumer Disputes Redressal Commission, Mumbai, has ordered Versatile Developers to refund ₹53.41 lakh to a homebuyer who paid for a flat in the Versatile Valley project at Nilje in Thane district. The refund includes 12% annual interest from the respective dates of payment till realisation.

The homebuyer, Hitesh Aniruddha Wasnikar, had booked Flat No. 1906 in D-Wing of the project for ₹54.50 lakh under an agreement for sale executed on January 4, 2020. The developer had agreed to hand over possession by November 30, 2020. However, the developer failed to complete the project and obtain the requisite Completion Certificate/Occupancy Certificate.

Instead, in June 2023, the developer allegedly sent the buyer a proforma possession letter through WhatsApp despite the absence of an Occupancy Certificate. The buyer declined to accept the possession as he considered it illegal. The delay also resulted in the buyer continuing to pay rent and home-loan EMIs.

According to the complaint, the buyer was paying ₹23,100 monthly rent and had paid ₹19.35 lakh towards loan EMIs up to August 2024, including ₹17.27 lakh as interest. The commission found that the developer had committed deficiency in service and had indulged in unfair trade practice.

The order was passed by Presiding Member Poonam V. Maharshi and Member Dr Nisha A. Chavan of the commission. The developer was proceeded against ex parte after failing to appear before the Commission despite service of notice.

In addition to the refund, the developer has been ordered to pay an additional amount of ₹2 lakh towards the mental agony suffered by the complainant, along with ₹25,000 towards the litigation charges. The developer has been given two months from receipt of the order to comply. In case of default, the interest on the refund amount will rise to 15% per annum from the date of default until realisation.
