A recent study has recommended expanding the Legal Aid Defence Counsel System (LADCS) to the taluka level across Maharashtra. The report, released by Union Minister of State for Law and Justice Arjun Ram Meghwal, highlights the need for decentralization to improve timely access to legal representation for marginalized and economically weaker accused persons.

The study found that Maharashtra has 33 functional LADCS offices, staffed by 379 personnel, including 234 defence counsels and 145 support staff. Despite handling 28,879 assigned cases and disposing of 18,079 in 2023-24, criminal case pendency remains a major challenge. The survey recorded 68,349 pending criminal cases at the taluka level across Maharashtra.

The report recommends establishing LADCS units at the taluka level to ensure timely and equitable access to justice. It suggests that the rollout initially focus on high-burden districts such as Pune, Chandrapur, Solapur, and Nandurbar. These districts account for a significant share of pending cases, with Pune having the highest number at 9,127.

The study also highlights significant disparities in legal aid coverage for undertrial prisoners. While 81% of undertrial prisoners in Nandurbar had received legal aid, 96% of undertrial prisoners in Aurangabad had not received free legal representation. Similar gaps were observed in other districts, including Jalna, Gadchiroli, Ahmednagar, and Latur.

The report is based on a study prepared by Renovate India with support from the Maharashtra State Legal Services Authority (MSLSA), District Legal Services Authorities (DLSAs), and legal aid NGOs. It emphasizes the need for a decentralized structure to enable immediate representation during critical stages such as remand, bail, and trial.

The expansion of the LADCS to the taluka level is expected to improve the disposal rate of cases and reduce pendency. The report notes that the disposal rate improved to 68.4% in 2024-25, indicating greater operational efficiency.
