Mumbai Court Grants Bail to Dr Rashmi Saluja in ED Money Laundering Case

A special Prevention of Money Laundering Act (PMLA) court in Mumbai granted bail to Dr Rashmi Saluja, former Executive Chairperson of Religare Enterprises Ltd, on Wednesday.

Dr Saluja has been booked in connection with a money laundering case being probed by the Enforcement Directorate (ED), which alleges irregularities in Employee Stock Option Plans (ESOPs) to the tune of Rs 179.54 crore.

The ED's counsel, Arvind Aghav, submitted that Dr Saluja, in collusion with other former executives, used her position to make unlawful gains through ESOPs of Care Health Insurance Ltd (CHIL) without discussion or prior approval from the boards or managements of Religare Enterprises Ltd and CHIL.

Dr Saluja's lawyer, Sudeep Passbola, contested the ED's claims and argued that the court did not have jurisdiction.

The court had taken cognisance of the prosecution complaint and issued notice to Dr Saluja, who appeared before the court on Wednesday and was formally taken into custody. Her lawyer then sought bail, which was opposed by the prosecution.

ED prosecutor Arvind A. Aghav argued that the accused should be dealt with strictly, given the economic offence allegedly committed.

However, the court granted Dr Saluja bail, observing that once cognisance has been taken, the ED and other authorities cannot exercise the power to arrest an accused named in the prosecution complaint.

The case involves several other former executives of Religare Enterprises Ltd, including Nishant Singhal, Nitin Aggarwal, Vaibhav Gawli, and Pratap Venugopal.

The Enforcement Directorate (ED) is still investigating the case, which involves allegations of money laundering and irregularities in ESOPs.

The court's decision to grant bail to Dr Saluja is significant, given the seriousness of the allegations against her.

The case highlights the importance of strict regulations and oversight in the corporate sector to prevent economic offences.

The outcome of the case will be closely watched, as it has implications for the corporate sector and the enforcement of money laundering laws in India.

In conclusion, the Mumbai court's decision to grant bail to Dr Rashmi Saluja in the ED money laundering case is a significant development in the ongoing investigation. The case underscores the need for strict enforcement of laws to prevent economic offences and protect the interests of investors and stakeholders.
