ED Raids 11 Premises In Mumbai, Delhi Over ₹360-Crore Bank Fraud

The Enforcement Directorate (ED) has conducted searches at 11 premises in Mumbai and Delhi linked to Alfara’a Infraprojects Pvt Ltd (AIPL) as part of a money-laundering investigation into an alleged bank fraud involving credit facilities of over ₹360 crore.

The searches, conducted on September 10, resulted in the seizure of ₹18 lakh in Indian currency, USD 9,567, and 860 Kwacha. The agency also froze fixed deposits worth approximately ₹1.02 crore, JPY 1.75 crore, and USD 1,03,145.

The money-laundering investigation was initiated based on an FIR registered by the Central Bureau of Investigation’s (CBI) Economic Offences Branch (EOB) in Chennai against AIPL and others, following a complaint filed by Bank of Baroda. According to the ED, AIPL had availed credit facilities of ₹103 crore from Bank of Baroda in 2012, which were subsequently enhanced to ₹360.50 crore in 2015.

The account was declared a non-performing asset (NPA) on June 18, 2018, with an outstanding amount of ₹255.74 crore. The ED said its investigation had found that Letters of Credit (LCs) worth around ₹75.02 crore were devolved, while Bank Guarantees (BGs) amounting to approximately ₹164.59 crore were invoked, resulting in the generation of alleged proceeds of crime.

A substantial portion of these funds was subsequently routed through various beneficiary and intermediary entities before being diverted to AIPL and its group entities through complex transactions designed to conceal the actual origin and movement of capital. The investigation also revealed that foreign bank guarantees were allegedly opened in the guise of exports of glazed tiles, but the purported shipments were never actually executed.

The ED searched premises linked to the accused persons, their close associates, family members, and entities reflecting financial linkages with the accused. During the searches, the agency seized documents and digital devices containing details of bank transactions, LCs, BGs, and immovable properties allegedly linked to the accused.

The ED's investigation has prima facie found that AIPL and its associates had allegedly siphoned off funds and caused wrongful loss to the lending banks. The agency is continuing its investigation into the matter.

The case highlights the importance of monitoring and regulating financial transactions to prevent money laundering and bank fraud. The ED's actions demonstrate the government's commitment to cracking down on financial crimes and protecting the interests of banks and financial institutions.

The investigation is ongoing, and the ED is expected to file a chargesheet in the case soon. The accused persons and entities are likely to face severe penalties and prosecution under the Prevention of Money Laundering Act (PMLA) if found guilty.

The case has significant implications for the financial sector and the economy as a whole. It underscores the need for stricter regulations and oversight to prevent such frauds and protect the interests of stakeholders. The ED's investigation and actions in the case are being closely watched by the financial community and the general public.

In conclusion, the ED's raids on Alfara’a Infraprojects and its associates mark a significant step in the investigation into the alleged bank fraud. The case is a reminder of the importance of vigilance and regulation in the financial sector to prevent such crimes and protect the economy.
