Mumbai MACT Awards ₹1.67 Crore To 2 Accident Victims

A Mumbai court has ordered a total compensation of nearly ₹1.67 crore to be paid to two accident victims in separate cases.

The Motor Accident Claims Tribunal (MACT), Mumbai, made the ruling on September 3 and 7, awarding ₹1.25 crore to a 31-year-old mechanic, Rafik Rais Idrisi, who suffered an above-knee amputation following an accident in Ghatkopar in October 2024.

The accident occurred when a vehicle collided with the autorickshaw Idrisi was travelling in, resulting in a compound Grade 3C fracture of the right femur shaft and right fibula. Idrisi was taken to Rajawadi Hospital and subsequently treated at Hiranandani Hospital and KEM Hospital.

The tribunal held that the accident was caused by the rash and negligent driving of the offending vehicle and rejected the insurer's defence that the driver did not possess a valid driving licence, fitness certificate, or permit.

The medical board assessed Idrisi's permanent disability at 80%, but the tribunal held that he had suffered 100% occupational disability due to the nature of his work as a mechanic.

In addition to the compensation for loss of future earning capacity, the tribunal also awarded amounts for medical expenses, conveyance, special diet, and pain and suffering, ultimately rounding the compensation to ₹1,25,51,800.

In a separate case, the MACT awarded ₹41,08,840 to Sukhbinder Singh Paramjit, a Diving Supervisor/Deep Sea Diver, for injuries suffered in a 2017 road accident at Jay Coach Junction Signal on the Western Express Highway in Goregaon.

Paramjit was riding pillion on a motorcycle that had stopped at a traffic signal when a truck collided with it, resulting in a sacropelvic fracture and 30% functional disability.

The tribunal's rulings highlight the importance of compensation for accident victims and the need for insurers to take responsibility for their clients' actions.

The cases also underscore the significance of the MACT in providing justice and compensation to those affected by road accidents in Mumbai.
